In the absence of a valid will, the law decides who gets your assets, who will look after your minor children (as guardians) and your individual wishes and personal situation will not be taken into account - the same laws apply to everyone who dies without a valid will. Losing a loved one is an incredibly difficult and sad time.

Excluding a beneficiary - if you are leaving someone out of your will such as a child, spouse you are separated from (but not yet divorced) or other similar class of beneficiary further advice and special drafting in your will is required.
Probate & Letters Of Administration
Report
When someone dies, often they will leave behind assets and property, and debts that need to be managed and finalised. In order to transfer these assets to the beneficiaries of the deceased person's will, an application must be made to the Supreme Court for a grant of Probate. If the person who died did not leave a valid will, the next of kin must apply for Letters of Administration.

Before you commit to anything in writing on behalf of your business, it is essential that you understand the legal and commercial implications of the documents you are signing.

The specific terms, conditions and warranties contained in service or supply agreements, heads of agreements or other contracts can impact your business in ways that may be contrary to your expectations and the purpose for which you entered into the agreement in the first place. This is especially true if you are presented with an agreement prepared by the other party and you have not obtained legal advice on its contents.
